These Terms of Service (“Terms”) govern your access to and use of PSDiary (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You represent and warrant you have the authority to agree to these Terms.

2. Your Account

• Keep your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized access or security issue.

3. Your Content

You retain ownership of the journal entries and other content you create (“User Content”). You grant PSDiary a limited, revocable license to store, process, and display User Content solely to operate and improve the Service. We never sell User Content.

4. Acceptable Use

• No unlawful, harassing, or abusive behavior.
• No attempts to gain unauthorized access or disrupt the Service.
• No reverse engineering, automated scraping, or data mining.
• Respect intellectual property and the privacy of others at all times.

5. Subscriptions & Billing

Certain features are available via paid membership (e.g., Premium). Pricing, billing cycle, and taxes are shown at checkout. Payments are processed by third-party providers; we do not store full payment card details. For how refunds are handled, please see our Refund Policy.

6. Credits-Based Premium Access

From time to time, PSDiary may grant credits (e.g., for sharing on social media). While credits > 0, you receive access to Premium features. One credit typically equals one day of Premium access and decrements daily until exhausted. Credits are promotional, have no cash value, and may be adjusted or revoked in cases of abuse.

7. Service Changes & Availability

We may add, modify, or remove features at any time. We strive for reliability, but do not guarantee uninterrupted availability.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or present a risk to the Service or other users. Upon termination, your right to use the Service ceases, but the sections intended to survive (e.g., limitations of liability) will continue to apply.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied (including fitness for a particular purpose or non-infringement). Use the Service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, PSDiary and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising from your use of the Service. Our aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the claim (or $0 if you used the free plan only).

11. Indemnity

You agree to defend, indemnify, and hold harmless PSDiary from any claims, damages, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflicts of law principles. You agree to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India. Where applicable law requires, you may also have local consumer rights.

13. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email or in-app notice. Your continued use of the Service after changes become effective constitutes acceptance.
